H.P. Excavating sues business for breach of contract

WHEELING — H.P. Excavating is suing a Valley Grove business alleging that it breached its contract.

H.P. Excavating filed the lawsuit against Lloyd Klages, Lloyd Klages LLC and Jeffrey B. Powers.

The plaintiff claims it entered into an oral contract with the defendants in 2017 in which the plaintiff agreed to perform services for the defendants including the installation of a four-inch water line on Realtree Road in Valley Grove, according to a complaint filed in Ohio Circuit Court.

H.P. claims it submitted an invoice to the defendants for $16,937.04 for the work that was performed, however, the defendants never paid the company for the work, according to the suit.

The plaintiff claims Klages and his company collected payment from Powers but did not pass that payment along to H.P.

The defendants have been unjustly enriched at H.P.'s expense, according to the suit.

H.P. is seeking compensatory damages in the amount of $16,937.04. It is represented by Brent A. Clyburn of Moundsville.
