Man says Asplundh employee caused car accident

PINEVILLE — A McGraws man is suing Asplundh alleging that it negligently entrusted a vehicle to one of its employees who caused a car accident.

Elmor Roy Fleshman was also named as a defendant in the suit.

Neil Lively was traveling northbound on Welch Pineville Road on Sept. 24, 2019, when Fleshman, who was driving an Asplundh Tree Expert truck, wrongfully turned left, causing Lively to slam into him, according to a complaint filed in Wyoming Circuit Court.

Lively claims Fleshman was negligent and failed to keep proper control of his vehicle and failed to act as a reasonably prudent person would.

The defendants' actions caused the plaintiff physical injury, medical costs, loss of mobility, distress, aggravation, annoyance and inconvenience.

Lively is seeking compensatory and punitive damages. He is represented by Timothy P. Lupardus of Pineville.
