Man says inspection company failed to property inspect a home

CHARLESTON — An Alum Creek man is suing the West Virginia Inspection Company alleging that a home he purchased was not adequately inspected by the business.

Tiler Lockhart had the defendant perform a home inspection on a home on June 16, 2020, and the employees, John Boggess and Larry Perkins, provided him with a home inspection report following the inspection, according to a complaint filed in Kanawha Circuit Court.

Lockhart relied upon the report when he decided to purchase the home, however, the home inspection incorrectly noted that the home had gas heat, as well as other issues that were not noted in the report.

"Defendant's failure to properly note that the Home did not have gas heat and its other related failures in its performance of a home inspection on the Home were negligence, were a breach of its contractual obligation with Mr. Lockhart and were breaches of the appropriate standard of care applicable to home inspectors in West Virginia," the complaint states.

Lockhart is seeking compensatory and punitive damages. He is represented by Shawn R. Romano and Miles B. Berger of Romano & Associates in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
