Couple sues General Motors for defective vehicle

CHARLESTON — A couple is suing General Motors for violating the West Virginia Consumer Credit and Protection Act.

Transportation Network VII was also named as a defendant in the suit.

Patrick Donovan and Amy Donovan purchased a 2019 Chevrolet Blazer from the defendants on Nov. 11, 2019, and after purchasing the vehicle, they noticed nonconformities that substantially impaired the use, value and safety of the vehicle, according to a complaint filed in Kanawha Circuit Court.

The Donovans claim they took the vehicle in several times to have the issues repaired, but the defendants failed to repair the vehicle despite at least five attempts.

"Manufacture failed and refused to provide a comparable replacement vehicle and to reimburse Plaintiffs pursuant to Plaintiffs' rights under West Virginia law," the complaint states.

The Donovans are seeking compensatory and punitive damages, as well as revocation of the vehicle. They are represented by Kristina Thomas Whiteaker of The Grubb Law Group in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
