Couple sues tree service for illegally removing trees from property

NEW CUMBERLAND — A couple is suing Beaner's Logging & Tree Service and its owner alleging property damage.

Dale L. Kinney and Beaner's Logging & Tree Service were both named as defendants in the suit.

Brandon Davis and Allyson Davis claim on Oct. 27, 2020, Kinney illegally trespassed onto their property and caused damage to their property, according to a complaint filed in Hancock Circuit Court.

When the defendants damaged the plaintiffs' property with machinery, the plaintiffs got an estimate to fix the property in the amount of $5,000. They claim the defendants cut down and destroyed trees, vines, brush, shrubs and sapling trees that were growing on the plaintiffs' property, according to the suit.

The plaintiffs had an appraisal tone on the timber that was illegally harvested and removed, which included 1,116 feet of Red Oak and 1,437 feet of Hard Maple, for a total of $6,558.30.

The Davises are seeking $5,000 for damages, $13,308.30 for treble damages for the trees, $10,000 for the loss of aesthetics and $50,000 in punitive damages. They are represented by Joseph Ludovici of Ludovici Law Office.

The case is assigned to Circuit Judge Jason Cuomo.
