AEP, Suddenlink, others sued for lineman's injury

WILLIAMSON — A man is suing American Electric Power alleging that he was injured when he fell from a utility pole.

American Electric Power Company, American Electric Power Service Corporation, Appalachian Power Company, Altice USA Inc., Cequel III Communications I, Cequel III Communications II and WBR Utilities were all named as defendants in the suit.

Robert M. Clark was employed by WBR as a lineman and on May 15, 2019, he was climbing a utility pole to remove utility lines and hardware owned by Suddenline and AEP to reinstall the lines and hardware on new poles when the pole he was climbing broke and fell to the ground while he was on it, according to a complaint filed in Mingo Circuit Court.

Clark claims he received multiple leg fractures, a left heel fracture, a skull fracture and closed head injury as a result of the fall.

The defendants were negligent in disclosing the deterioration and weakness in the poles.

Clark is seeking compensatory and punitive damages. He is represented by Brian L. Ooten of Ooten Law and Kyle Salyer of Morgan Collins Yeast and Salyer.

The case is assigned to Circuit Judge Miki Thompson.
