CHARLESTON — A man is suing Cabin Creek Health Systems for retaliatory discharge.
Scott VanBrocklin was employed by Cabin Creek as a pharmacist from January 2015 until July 2020, according to a complaint filed in Kanawha Circuit Court.
VanBrocklin claims he informed management on multiple occasions that the pharmacy was suffering technician shortages that made it difficult to keep up with the workload and comply with regulatory and statutory requirements. He also complained about the scanning technology, which he claims was defective and inadequate.
Despite these complaints, the defendants did not fix the issues and, instead, retaliated against VanBrocklin by fabricating complaints about long waits and put him on an improvement plan and ultimately terminating his employment, according to the suit.
VanBrocklin claims the defendants' actions were a violation of public policy.
VanBrocklin is seeking compensatory and punitive damages. He is represented by Christopher D. Pence and James P. McHugh of Hardy Pence in Charleston.
The case is assigned to Circuit Judge Tera Salango.
