Woman sues Select Portfolio Services for predatory lending

PRINCETON —A woman is suing Select Portfolio Servicing for breach of contract, fraud and violations of the West Virginia Consumer Credit and Protection Act.

Nancy Pearl Abshire, by her son, Glen A. Abshire, filed the lawsuit alleging predatory lending practices and the needless foreclosure and quiet title for a home, according to a complaint filed in Mercer Circuit Court.

Nancy Abshire's now-deceased husband was solicited to refinance their home in 2007 and a bogus appraisal was performed. 

Nancy Abshire was hospitalized in 2020 and was admitted to a skilled nursing care facility and was no longer able to handle her affairs so her son began making payments on the loan, however, in January, the defendant began returning the monthly payments and repeatedly refused to accept the payments, despite Glen Abshire having both the ability and willingness to pay.

The plaintiff is seeking for the court to enjoin the defendant from conducting a foreclosure sale of the plaintiff's property and all equitable relief. The plaintiff is represented by Bren J. Pomponio of Mountain State Justice in Charleston.
