Man sues Lowe's after mower overturns on him, fractures spine

ELKINS —A man is suing Lowe's Home Centers for injuries sustained while he was working.

Alexander Oldaker was an employee at Lowe's and was instructed to load and/or operate mechanized equipment, such as lawnmowers, by driving them up ramps and onto the beds of customer's vehicles, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.

Oldaker claims on May 31, 2019, he was operating a mower on unsafe and non-compliant ramps when the mower overturned and fell off the ramps, causing Oldaker to be trapped underneath the lawnmower and causing him severe injuries, including a T-12 burst fracture of his spine, rendering him without sensation below the knees and without the use of both of his feet.

Oldaker is seeking compensatory damages. He is represented by Clayton J. Fitzsimmons, Robert P. Fitzsimmons, Donald M. Kresen and Christy Pill Fisher of Fitzsimmons Law Firm in Wheeling.
