Fayette County Commission sues companies for water contamination

CHARLESTON — The Fayette County Commission filed a lawsuit against the National Grid NE Holdings 2 and others for contaminating Loop Creek.

Eastern Associated Coal, Pardee and Curtin Realty, Quercus West Virginia, Continental Insurance Company, The Travelers Casualty and Surety Company and Hanover Insurance Company were also named as defendants in the suit.

The Fayette County Commission claims property located within Johnson Fork-Loop Creek Watershed was the focus of mining operations and mining waste disposal throughout the 19th and 20th centuries and the area was contaminated, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

The commission claims the contaminants have contributed to the degradation of Loop Creek. 

The commission is represented by Michael O. Callaghan of Neely & Callaghan.
