Wayne County man sues FedEx for injuries from accident

WAYNE — A man says FedEx is responsible for an accident in Fort Gay that caused him injuries.

Gary Davis and Kenneth Brown were also named as defendants in the suit.

Mark A. Spaulding II was working for the West Virginia Department of Transportation, Division of Highways as a flagman and was standing on W.Va. 52 in Fort Gay when a FedEx van owned by Davis and operated by Brown failed to stop, striking a motorcycle and then striking Spaulding, who was directing traffic, according to a complaint filed in Wayne Circuit Court.

Spaulding claims he suffered injuries and damages, including medical expenses, lost wages, pain and suffering, physical limitations, a diminished capacity to enjoy life, and other consequences.

Spaulding is seeking compensatory and punitive damages with pre- and post-judgment interest. He is represented by Robert A. Campbell and R. Chad Duffield of Farmer Cline & Campbell in Charleston.
