Union sues Matheny & Sons for failure to make required contributions

HUNTINGTON — A local union is suing Matheny & Sons General Contracting and its owner alleging it did not follow a collective bargaining agreement to which it was obligated.

Plumbers & Pipefitters Local Union 521; Plumbers & Pipefitters Local 521 Health and Welfare Fund; Plumbers & Pipefitters Local 521 Pension Fund; Plumbers & Pipefitters Local 521 Supplemental Health Fund; Plumbers & Pipefitters Local 521 Annuity Fund; and Plumbers & Pipefitters National Pension Fund filed a lawsuit against Matheny & Sons General Contracting and Steve Matheny for violating a collective bargaining agreement, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

The union claims on Nov. 22, 2019, Matheny signed the collective bargaining agreement, which requires employers to make monthly payments and filed monthly remittance reports for fringe benefits, however, the defendants failed to make contributions from May 2020 through September 2020 and how owes $49,919.63.

The union is seeking payment of the required contributions and liquidated damages. It is represented by John F. Dascoli in Charleston.
