Owners in church property want court to sell property and distribute proceeds

NEW CUMBERLAND — Three individuals are suing the trustees of Chapel Hill Wesleyan Church because they want the circuit court to sell property and divvy it up between the owners.

Teresa Baker Byard, Kenneth Williamson, Warren Elliott, John Jackson and Brendan Zevios, as trustees of the Chapel Hill Wesleyan Church

Donna Mayhew and Deborah Black, as co-executrixes of the estate of Charles Jo Baker, and Kyle Harvey, have ownership interests in property in Chester, along with the defendants, and cannot agree as to the sale or division of the property, according to a complaint filed in Hancock Circuit Court.

The plaintiffs claim they want the court to order the sale of the property and distribute the proceeds of the sale since they cannot agree on division or sale on their own.

"The interests of one or more of those who are entitled to the property, or its proceeds, will be promoted by a sale of the entire property, and the interests of the other person or persons so entitled will not be prejudiced thereby," the complaint states.

The plaintiffs are asking the court to sell the property and distribute the money among the owners. They are represented by Daniel J. Guida of Guida Law Offices.
