Charleston sues Mountaineer Tire for failure to pay taxes, fees

CHARLESTON — The city of Charleston is suing Mountaineer Tire alleging it failed to pay taxes and fees.

Dawn Marie Burns, owner of Mountaineer Tire, was also named as a defendant in the suit.

Charleston claims Burns and Mountaineer Tire failed to pay business and occupation taxes, city service fees and business license taxes in the amount of $39,493.01, according to a complaint filed in Kanawha Circuit Court.

The city claims it informed Burns that she had failed to pay the taxes and fees on Nov. 4, 2020, and again on Dec. 18, 2020, and Jan. 4, 2021. It then sent an administrative subpoena on Jan. 19, but the defendant never engaged in the audit.

On Marcy 18, the city filed liens with the clerk of the Kanawha County Commission because of the failure to pay taxes and fees, according to the suit.

The city is seeking payment of the fees with interest. It is represented by Assistant City Attorney Joseph J. Baldwin.

The case is assigned to Circuit Judge Maryclaire Akers.
