MonPower sued by property owners for breach of contract, negligence

NEW MARTINSVILLE — A couple is suing Monongahela Power Company alleging breach of contract and negligence by its employees.

C.W. Wright Construction Company was also named as a defendant in the suit.

Michael J. Stoflinsky and Janice R. Stoflinsky are the owners of the surface of property that MonPower maintains an easement and MonPower routinely has C.W. Wright perform construction and earthmoving services on easements in the county, according to a complaint filed in Wetzel Circuit Court.

When MonPower did this in 2018 during the process of replacing a then-existing electric distribution line, Andy Nutter of MonPower threatened Michael Stoflinsky if he did not allow C.W. Wright onto the property. The Stoflinskys were then accused of stealing a gate blowing to C.W. Wright and accused of property damage, according to the suit.

The plaintiffs are seeking special damages in the amount of $60,000. They are represented by Bradley Stephens of Stephens Law Office in Morgantown.

The case is assigned to Circuit Judge Jeff Cramer.
