New York Energy sues Etta Mae for breach of contract

CLARKSBURG — New York Energy LLC is suing Etta Mae Inc. alleging a breach of contract.

Gregory Kent Collins was also named as a defendant in the suit.

Collins approached NYE in 2020 regarding an opportunity to purchase equipment on an equipment list from Brooks Run Mining Company and NYE agreed to provide $250,000 to fund the purchase of the equipment, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.

NYE claims the defendants sold some of the equipment and repaid NYE $70,000, but since then the defendants have not acted in NYE's best interest and sold some of the equipment but did not provide any proceeds to NYE.

The defendants then stopped communicating with NYE, according to the suit.

NYE is seeking judgment against the defendants in the amount of $329,100, as well as punitive damages. It is being represented by Travis A. Knobbe of Spilman Thomas & Battle on Pittsburgh.
