Pennsylvania man sues Mortimer Realty for refusing to close a sale

NEW CUMBERLAND — A Pennsylvania man is suing Mortimer Realty Company for refusing to complete a transaction.

Robert Salvaggio, Angela M. Mazur and Robin L. Viola were also named as defendants in the suit.

Richard J. Pollak entered into a contract on Nov. 25, 2020, with Salvaggion for the purchase of real estate in Newell wherein Mazur was the real estate agent, Viola was the broker and Howard Hanna was the real estate company representing the seller, according to a complaint filed in Hancock Circuit Court.

The defendants breached the real estate contract by refusing to close the transaction, according to the suit.

The plaintiff claims he has been forced to incur additional rental expenses, travel costs, housing costs and legal fees.

The defendants' action is tortious interference with a contract, according to the suit.

Pollak is seeking compensatory damages and interest. He is represented by Erik A. Schramm of Hanlon Estadt McCormick and Schramm.

The case is assigned to Circuit Judge Jason Cuomo.
