Woman says State Farm should have paid underinsurance claims

WHEELING — A woman is suing State Farm Mutual Automobile Insurance Company following a car accident.

Shelley L. Showalter was operating a 2019 Chevrolet Spark on May 26, 2019, when David McConnell, an Ohio County resident, was on W.Va. 88 and negligently and recklessly struck Showalter's Spark with his 2001 Kia Optima, according to a complaint filed in Ohio Circuit Court.

Showalter claims McConnell failed to control the speed of his vehicle and collided with Showalter's vehicle. McConnel failed to exercise due care and drive too fast for the circumstances.

McConnell's insurance company, Allstate, paid out the policy limits of McConnell's policy and State Farm, which insured Showalter, should have paid out the underinsurance claims but refused to do so.

Showalter is seeing compensatory damages. She is represented by Jacob M. Robinson and David P. Robinson of Robinson Law Offices.
