Foster Supply sues Advanced Concrete for failure to pay invoices

WINFIELD — Foster Supply is suing Advanced Concrete Contracting alleging it failed to pay purchases of more than $18,000.

James R. Nunamaker is doing business as Advanced Concrete Contracting.

Foster Supply claims in January 2019, Advanced Concrete purchased materials, goods and services, but did not pay for the purchases, according to a complaint filed in Putnam Circuit Court.

The company claims it extended a settlement and agreed to reduce the balance owed to $3,000 per month until paid in full.

Foster Supply claims Advanced breached its contract and owes more than $18,000. It claims it expected to be paid the reasonable value of the materials, goods and services provided.

Foster is seeking damages in the amount of $18,995.48 with interest. It is represented by Michael R. Proctor and Zachary J. Rosencrance of Bowles Rice LLP in Charleston.
