Man sues SK Transport for breach of contract

WINFIELD — An Illinois man is suing SK Transport Inc. claiming that it breached its contract with him.

Charles Shannon was also named as a defendant in the suit.

Terry H. Upton and SK Transport entered into a building lease agreement on Dec. 1, 2019, for property in Poca, according to a complaint filed in Putnam Circuit Court. Shannon signed the agreement in his capacity as president of SK Transport.

Upton claims the defendants owed $3,500 per month from Dec. 1, 2019, until Nov. 30, 2029.

Five months into that agreement, the defendants moved out of the property, breaching the agreement, and left destruction in their wake, severely damaging the premises, according to the suit.

Upton claims in an attempt to mitigate damages he attempted to re-lease the premises but so far has been unsuccessful.

Upton is seeking compensatory damages with pre- and post-judgment interest. He is represented by Debra C. Price of Moye Law Firm in Cross Lanes.
