Insurance company sues businesses, individuals over fire

WILLIAMSON — Scottsdale Insurance Company is suing Coalfield Lumber alleging it and others need to settle differences regarding a fire.

Bryan Jude, the estate of Madelina Stacy, Brandon Stacy, Kermit Volunteer Fire Department, Mountaineer Ballroom and Tint's Steak and Grill were also named as defendants in the suit.

Scottsdale Insurance Company claims two members of Mountaineer entered into a 10-year lease-to-own agreement for Tint's with Brandon Stacy on Dec. 17, 2020, and the following day, Scottsdale issued a policy of insurance, according to a complaint filed in Mingo Circuit Court.

The company claims 10 days after the policy went into effect, a fire occurred and destroyed the entire structure and Scottsdale determined the building was a total loss, however, multiple people and businesses are claiming an interest in and a right to the policy proceeds.

The company is seeking for the court to take the full amount of the policy and required the defendants to settle between themselves who gets what from the policy limits. It is represented by Lee Murray Hall of Jenkins Fenstermaker in Huntington.

The case is assigned to Circuit Judge Miki Thompson.
