Couple sues property owner, logging company for damage

HUNTINGTON — A Huntington couple is suing a property owner and a login company that they alleging they are responsible for property damages.

Robert Adkins Jr. and Mike Sark Farm Logging were named as defendants in the suit.

Jill LaFear and Seth Cyfers lived on Prices Creek Road and Adkins lived in the adjacent lot and began removing trees and excavating his property, according to a complaint filed in Cabell Circuit Court.

LaFear and Cyfers claim in doing so, Adkins weakened the soil and changed the flow of the water, creating damage to their property.

The West Virginia Division of Forestry cited Sark Logging for operating without a license and it was ordered to cease work, however, the company refused and said it would complete the job. In doing so, the plaintiffs suffered extensive damages to their property. They claim the defendants were negligent and caused the damages.

The plaintiffs are seeking compensatory and punitive damages. They are represented by Abraham J. Saad, Hoyt Glazer and Eric Anderson of Glazer Saad Anderson in Huntington.
