Man sues Boyd Company for property damage

CHARLESTON — A man is suing Boyd Company and Fast Cast alleging property damages.

Harry Durham owns property in Diamond and Boyd owns property adjacent to Durham, according to a complaint filed in Kanawha Circuit Court.

Durham claims in 2004, Boyd increased the elevation of its property, which created a downflow of water from its property into a valley on the property, which is abutting the plaintiff's residence.

There were no drainage problems until 2020, when the culvert was blocked and the water did not drain properly, causing water to accumulate in the valley and into the plaintiff's residence, according to the suit.

Durham is seeking compensatory and punitive damages. He is represented by Michael J. Del Giudice of Ciccarello, Del Giudice and LaFon in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
