Woman sues Heritage Center for retaliatory discharge

HUNTINGTON — A woman is suing Heritage Center for retaliatory discharge.

Mary Holbrook also was named as a defendant in the suit.

Heather McCloud was hired by the defendants as a certified nurse aide (CNA) on Oct. 18, 2018, and worked full-time making approximately $8 per hour and eventually, her pay went up to $11.35 per hour.

McCloud claims she was terminated on Jan. 29, 2020, after she complained about staffing issues, which caused her to work approximately 16 hour-shifts for six or seven days per week.

The defendant retaliated against the plaintiff by firing her. She claims she was fired under the premise that she bumped a patient but that it was actually because of her complaints about understaffing, according to the suit.

McCloud is seeking compensatory and punitive damages. She is represented by Hoyt Glazer, Abraham Saad and Eric Anderson of Glazer Saad Anderson LC in Huntington.

The case is assigned to Circuit Judge Gregory Howard Jr.
