CHARLESTON — Air Cargo Carriers LLC is suing Aviation Risk Management Associates alleging it failed to procure the proper insurance needed.
ACC employee Anh Ho was killed in an airplane crash on May 5, 2017, during a regularly scheduled cargo route while attempting to land at Yeager Airport. Ahn and the pilot, Captain Jonathan Alvarado, were both killed in the crash, according to a complaint filed in Kanawha Circuit Court.
On May 15, 2019, Virginia Chau, the administratrix of Ho's estate, filed a wrongful death lawsuit against ACC and the plaintiff sought coverage through its policy with the defendant, according to the suit.
ACC claims the defendant, despite acting as a specialty risk manager and insurance consultant and broker, failed to advise ACC that there was insurance coverage available that would cover deliberate intent claims and failed to procure the appropriate coverage.
ACC is seeking compensatory damages. It is represented by James C. Stebbins and Spencer Elliott of Lewis Glasser in Charleston.
The case is assigned to Circuit Judge Maryclaire Akers.
