Woman says Valley Center supervisor created hostile work environment

CHARLESTON — A woman is suing Valley Center alleging a supervisor caused a hostile work environment.

Tabitha Ross was employed by Valley Center and, on multiple occasions, supervisor Tina Starcher made inappropriate comments, such as calling her sexy and touching her butt and between her legs, according to a complaint filed in Kanawha Circuit Court.

Ross claims when she began dating a man, Starcher became upset and started an argument with her and began kicking chairs at the nurse's station as well as placing ice down the plaintiff's pants.

The plaintiff complained about Starcher's harassing behavior and requested not to be scheduled to work with her, but the defendants would not grant her request, according to the complaint.

Ross claims she was constructively discharged on June 6, 2019, as a result of the harassment and hostile work environment.

Ross is seeking compensatory and punitive damages. She is represented by Mark A. Atkinson and John-Mark Atkinson of Atkinson & Polak.

The case is assigned to Circuit Judge Carrie Webster.
