Woman sues after falling on South Charleston street

CHARLESTON — A woman is suing the city of South Charleston claiming she was injured when she fell on a city street.

Shanna Brown was on McDonald Avenue on June 3, 2019, when she tripped and fell on a broken drain grate, according to a complaint filed in Kanawha Circuit Court.

Brown claims the defendant knew or should have known that the drain gate was defective and hazardous if not maintained and owed a duty of care to the people that walk on its city street.

"The Defendant owed a duty of care to the people that walk its city street to keep it in a manner that does not allow hazardous conditions to develop and then not repair them," the complaint states.

Brown is seeking compensatory damages with pre- and post-judgment interest. She is represented by Kevin Davis in Charleston.

The case is assigned to Circuit Judge Ken Ballard.
