BAM Trucking says Lexington Coal failed to pay for services

CHARLESTON — BAM Trucking is suing Lexington Coal Company alleging it failed to pay more than $55,000 owed for services.

BAM entered into a hauling and delivery agreement in 2018 and the plaintiff provided coal haulage in July 2019 and invoiced the defendant for two invoices in the amounts of $52,296.69 and $3,545.20, according to a complaint filed in Kanawha Circuit Court.

The defendant said they would make timely payments, but failed to do so. 

"Lexington Coal Company did not make these payments in a timely manner," the complaint states. "Furthermore, Lexington Coal Company did not make the full judgment payment totaling $55,841.20 as required..."

BAM is seeking the amount owed. It is represented by John W. Alderman III of the Law Offices of John W. Alderman in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
