Man sues laundromat after employee attacked him with baseball bat

CHARLESTON — A man is suing Montgomery Coin Laundry alleging he was injured by one of its employees.

D&J Property Management and Jennifer Pullens were also named as defendants in the suit.

Dallas Lee Sizemore went to Maytag Laundry on Aug. 28, 2020, when he was injured by an employee who struck him with a baseball bat, according to a complaint filed in Kanawha Circuit Court.

Sizemore claims the defendants hired Terrance Brockman to provide security, maintenance and management for the buildings and premises, but Brockman was a felon for two burglary charges in 2008 and 2014 who had a reputation for assault.

Sizemore claims he was meeting a friend and was waiting for his friend on the sidewalk in front of Maytag Laundry when Brockman asked him to leave and he stated that he was waiting for a friend and would be leaving as soon as his friend arrived. Brockman then retrieved a baseball bat, came back and struck him in the knee.

The plaintiff called 911 and was transported to Charleston Area Medical Center, and he continues to suffer from his injuries, according to the suit.

Sizemore is seeking compensatory and punitive damages. He is represented by Ronald N. Walters Jr. of Walters Law Firm.

The case is assigned to Circuit Judge Maryclaire Akers.
