WAYNE – A Fort Gay woman is suing the Wayne County Board of Education after her daughter was injured playing volleyball in gym class at Tolsia High School.
Pearl Slone filed her complaint on behalf of Marie S. Slone against the school board in Wayne Circuit Court.
According to the complaint, Marie Slone was playing volleyball in gym class on September 12, 2019. Marie, who has attention deficit disorder, and the rest of her class were left unsupervised for 10-15 minutes, during which time she went to retrieve a volleyball from the top of the gym bleachers that were stacked 12-15 feet off the ground.
“Plaintiff was unsure of how to get down from the bleachers and was encouraged by classmates to jump off of the stacked bleachers onto a mat,” the complaint states. “Without the supervision of Tolsia High faculty, plaintiff was pressured by her classmates and jumped off of the stacked bleachers onto a mat and suffered severe injury.”
The complaint says Marie suffered severe and disabling injuries, was forced to seek medical treatment and incur medical expenses, has and will incur pain and suffering, mental anguish, aggravation, inconvenience, loss of enjoyment of life, loss of ability to function, lost wages, past and future medical and other expenses.
The plaintiffs seek compensatory damages as well as pre- and post-judgment interest, court costs, attorney fees and other relief.
The plaintiffs are being represented by Michael G. Simon and Kevin M. Pearl of Frankovitch, Anetakis, Simon, DeCapio and Pearl LLP in Weirton.
