HUNTINGTON — Rigging Gear Sales is suing The Early Construction Co. alleging it failed to pay for damages to leased equipment.
Lifting Gear Hire Corporation and Lift-All Company were also named as defendants in the suit.
On June 10, 2019, Early Construction reserved equipment and on June 27, 2019, an employee of the defendant accepted the terms of the contract, according to a complaint filed in Cabell Circuit Court.
Rigging claims on July 10, 2019, while the leased equipment was in the defendant's care, there was a failure and the material being lifted fell and impacted the leased equipment.
There was extensive damage to the leased equipment and Early has declined to pay the damages and costs incurred by Rigging as a result of the incident, according to the suit
Rigging is seeking compensatory damages. It is represented by Charles R. Steele, D. Andrew McMunn and Thomas G. Steele of Steele McMunn in Clarksburg.
The case is assigned to Circuit Judge Christopher Chiles.
