WHEELING — A man is suing the Police and Sheriff Support Alliance alleging it violated the Telephone Consumer Protection Act when it called him when he was on the National Do Not Call Registry.

On Jan. 13, Michael Frank received a phone call from the defendant soliciting donations, according to a complaint filed in Ohio Circuit Court and removed to U.S. District Court for the Northern District of West Virginia.

Frank claims he was registered on the National Do Not Call Registry and he did not consent to be called. He also requested to be added to the alliance's internal do not call list.

Frank is seeking a bench trial and $1,500 to be awarded to him for the one violation of the TCPA., along with treble damages and court costs. He is representing himself.

U.S. District Court for the Northern District of West Virginia case number: 5:21-cv-00088
