Man accuses Lendmark Financial of consumer credit violations

WILLIAMSON — A man is suing Lendmark Financial Services of West Virginia alleging the defendant violated the West Virginia Consumer Credit and Protection Act (CCPA).

Lucien Savage financed a vehicle through Lendmark that was a lemon and Lendmark rolled over his financing to another vehicle, according to a complaint filed in Mingo Circuit Court.

Savage claims he did not understand why the finance did this, as the dealership was attempting to fix his original car, but he attempted to pay for the vehicle until he fell behind. He claims when he fell behind, the defendant continued to send him harassing and abusive debt collection communications.

Savage claims the defendant's actions caused him to suffer emotional distress.

Savage is seeking compensatory damages. He is represented by Troy N. Giatras, Matthew W. Stonestreet and Phillip A. Childs of the Giatras Law Firm.

The case is assigned to Circuit Judge Miki Thompson.
