FAYETTEVILLE — The Fayette County Commission is suing the Insurance Company of North America alleging contamination.
The county commission claims it needs to obtain relevant to the resource that are or may be available to abate toxic contamination of the surface waters and groundwaters within the Johnson Fork-Loop Creel watershed within the county, according to a complaint filed in Fayette Circuit Court.
The commission claims property located within Johnson Fork-Loop Creek Watershed was the focus of mining operations and mining waste disposal throughout the 19th and 20th centuries and the area was contaminated.
The commission claims the contaminants have contributed to the degradation of Loop Creek.
The commission is represented by Michael O. Callaghan of Neely & Callaghan.
The commission previously filed a lawsuit in federal court for the same contamination against the coal companies.
