Former employees sue MarkWest for failing to properly pay them

HUNTINGTON — Two former inspectors are suing MarkWest Energy Partners alleging the defendant violated the Fair Labor Standards Act by failing to pay them overtime.

Brian Ison and Chris Hamilton were inspectors for MarkWest and worked on a day-rate basis without overtime pay, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

The plaintiffs claim they would typically work six days a week for about 12 hours per day, but did not receive any kind of overtime pay even though they worked well above 40 hours per week.

"MarkWest uniformly denies Plaintiffs and the Putative Class Members overtime for the hours they work in excess of 40 hours in a single workweek," the complaint states.

Ison and Hamilton claim the defendant violated the FLSA, the Ohio Wage Act and the Ohio Prompt Pay Act.

The plaintiffs are seeking compensatory damages. They are represented by Anthony J. Majestro and James Nelson of Powell & Majestro as well as Michael A. Josephson, Andrew Dunlap and Taylor Jones of Josephson Dunlap and Richard R. (Rex) Burch of Bruckner Burch PLLC.
