Brother, niece sue American Memorial Life Insurance Company for refusing to pay out benefits

CHARLESTON — A couple is suing American Memorial Life Insurance Company and others for refusing to pay out benefits after the death of a family member.

Assurant inc., Orca Life Inc. and David Austin Norfleet were also named as defendants in the suit.

Sherman Clark and Amanda Clark filed the lawsuit on behalf of Robert Clark, who died on Jan. 20, according to a complaint filed in Kanawha Circuit Court.

The Clarks claim Robert Clark was diagnosed with liver cancer in October 2020 and died on Jan. 20 because of the cancer. While making his funeral and burial arrangements, the brother and niece discovered that the defendants were refusing to pay life insurance policy benefits.

The defendants also continued to send past due notices, even after being aware that Robert Clark had died.

The Clarks are seeking compensatory and punitive damages. They are represented by R. Scott Long and Stephen Hastings of Hendrickson & Long.

The case is assigned to Circuit Judge Jennifer Bailey.
