Lab sues CM Mining for failing to pay for environmental testing

CHARLESTON — Standard Laboratories is suing CM Mining alleging breach of contract for failing to pay more than $100,000.

The environmental testing business agreed to provide environmental testing services to the defendant between October 2019 and March 2020, according to a complaint filed in Kanawha Circuit Court.

The plaintiff provided a service and billed the defendant, but so far the defendant has failed to pay $111,246.48, according to the suit.

Standard Laboratories claims it sent six separate invoices to the defendant, each between $13,000 and $23,000.

"The total outstanding invoices aggregate to a total outstanding principal amount of $111,246.48 owed and due to Plaintiff," the complaint states.

The plaintiff is seeking damages for unjust enrichment and breach of contract.

Standard Laboratories seeks judgment in the amount of $111,246.48 with interest. It is represented by Evan S. Aldridge of Flaherty Sensabaugh Bonasso in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
