Woman says mortgage company for wrongfully applying fees to her escrow account

CHARLESTON — A woman is suing Shellpoint Mortgage Servicing claiming they were negligent and have caused her to nearly lose her home.

Newrez is doing business as Shellpoint Mortgage Servicing.

Pamela White's husband of nearly 30 years passed away and Shellpoint then issued a monthly statement that was substantially more than her usual mortgage payment, according to a complaint filed in Kanawha Circuit Court.

White claims after an extensive investigation, she discovered the defendant had erroneously paid off debts owed by a non-borrower and assessed those fees to her via her escrow account and she was put in arrears that substantially increased her risk of losing her home.

White is seeking actual damages and civil penalties. She is represented by Sarah K. Brown and Bren J. Pomponio of Mountain State Justice.

The case is assigned to Circuit Judge Tera Salango.
