Man sues West Virginia American Water for water main break damage

CHARLESTON — West Virginia-American Water Company is being sued by a Cross Lanes resident alleging that a water main break caused him personal property damages.

Richard Brian Chandler II discovered that a water main outside his residence had ruptured on July 2, 2019, and had caused damage to his residence and personal property, according to a complaint filed in Kanawha Circuit Court.

Chandler claims he contacted the defendant and the defendant came out and attempted to repair the break. On Dec. 3, 2020, he discovered the same water main and ruptured a second time, causing more damage. The damage well exceeds $50,000.

Chandler is seeking a judgment against the defendants for all damages with pre- and post-judgment interest. He is represented by Brent K. Kesner and Shawn C. Gillispie of Kesner & Kesner in Charleston; and Carrie Newton.

The case is assigned to Circuit Judge Louis Bloom.
