Man accuses Clendenin police officers of excessive force

CHARLESTON — A man is suing the city of Clendenin after he was allegedly subjected to excessive force by several officers.

Officers Pena, Craddock and Kendall were also named as defendants in the suit.

Matthew Myers was arrested on May 28, 2019, and during his arrest, the defendants used excessive force and caused Myers injuries, according to a complaint filed in Kanawha Circuit Court.

Myers claims his brother was pulled over on May 28, 2019, and since Myers owned the vehicle his brother was in, he went to the scene of the incident. However, the officers cursed at Myers and demanded that he leave, so he got back in his vehicle and went to go back home.

After leaving the scene, the officers followed Myers, pulled him over and beat him before arresting him and detaining him, according to the suit.

Myers claims he was released the following day.

Myers is seeking compensatory and punitive damages. He is represented by Faun S. Cushman of Pritt & Spano.

The case was initially filed in Kanawha Circuit Court, but was then removed to U.S. District Court for the Southern District of West Virginia.
