Ascentium Capital sues Spring Valley Charter Company for breach of contract on bus lease

HUNTINGTON — Ascentium Capital is suing Spring Valley Charter Company for failing to pay under a lease agreement.

Gary Yazell was also named as a defendant in the suit.

Ascentium claims the defendants entered into a lease for a 2011 Van Hool passenger bus on Oct. 2, 2018, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

In April 2020, the lease was modified and again in July 2020 in light of COVID-19, however, the defendants failed to make the required payments and the last payment for the lease was made on Dec. 9, 2020. The total balance due on the lease is $106,420.30. The plaintiff took possession of the vehicle in January 2021 and sold it in May for $50,000.

Ascentium claims the defendants breached their contract and owe damages suffered.

Ascentium is seeking compensatory damages. It is represented by R. Andrew Hutchinson of Baker Donelson Bearman Caldwell & Berkowitz.
