Former employee says Roane General Hospital wrongfully terminated her employment

CHARLESTON — A woman is suing Roane General Hospital alleging that her employment was wrongfully terminated.

Wanetta Cottrell was employed by the hospital and during her employment, she suffered an injury to her shoulder and was diagnosed with bursitis, according to a complaint filed in U.S. District Court for the Southern District of West Virginia.

Cottrell claims in May 2019 it was confirmed she had actually suffered a torn rotator cuff and she was taken off work by her treating physician for a period of time. She subsequently filed for Family and Medical Leave Act benefits and was approved for three months.

Two months and two weeks later, the defendant terminated the plaintiff's employment while she was still on FMLA leave, according to the suit.

Cottrell is seeking compensatory and punitive damages. She is represented by John-Mark Atkinson and Mark A. Atkinson of Atkinson & Polak.
