Fayetteville man sues WVDOT for mud on the road that caused a car accident

CHARLESTON — A Fayetteville man is suing the West Virginia Department of Transportation for a car accident that caused him injuries.

Shawn P. Cales was operating a 2005 Toyota truck on July 16, 2019, and the defendant was actively cleaning ditches and left mud in the roadway, according to a complaint filed in Kanawha Circuit Court.

Cales claims it began to rain, causing slippery road conditions and he crashed his vehicle.

The plaintiff endured pain, suffering, mental anguish and emotional distress, according to the suit.

Cales claims he suffered lost wages and a diminished capacity to enjoy life because of the crash.

Cales is seeking compensatory damages. He is represented by Anthony M. Salvatore at Hewitt & Salvatore in Fayetteville.

The case is assigned to Circuit Judge Maryclaire Akers.
