Couple settles after suing Joe Holland Chevrolet for defective vehicle

CHARLESTON — A couple sued Joe Holland Chevrolet alleging a vehicle they purchased was defective, but they later settled the case.

Danny and Adrianne Harper purchased a 2021 Chevrolet Trailblazer RS on Jan. 20, 2021, but five days later, the vehicle began having issues, according to a complaint filed in Kanawha Circuit Court.

The Harpers returned the vehicle on Jan. 25, 2021, because the engine light was on. They took the vehicle again on April 15, 2021, due to a strong fuel odor inside and outside the vehicle. The plaintiff then called the defendant multiple times for updates before she could finally get her vehicle back on May 6.

The following day, the vehicle was experiencing the same issues. On May 18, the plaintiffs again dropped the vehicle off. The plaintiffs claim the defendant violated West Virginia Consumer Protection Statutes.

The Harpers also claimed the defendant was negligent.

The plaintiff later filed a stipulation of dismissal without prejudice, noting the parties had come to an agreement.

The Harpers were seeking compensatory damages. They were represented by Michael Cary of Cary Law Offices in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
