Man sues Heists Restaurant Group for loan default

CHARLESTON — A man is suing Heists Restaurant Group alleging the group owes more than $800,000 after defaulting on a loan.

Jeffery Barr Jr., Dana Mallett Jr. and Heath Null were also named as defendants in the suit.

Heists executed a purchase money note for $800,000 to David R. Pollitt on Sept. 25, 2018, for real property, according to a complaint filed in Kanawha Circuit Court.

Pollitt claims the defendants became delinquent on their obligations and the plaintiff claimed the loan was in default. The property was then sold at auction for $150,000 on Dec. 30, 2020.

After deducting costs of the foreclosure sale, the trustee applied $147,070.58 toward the outstanding balance. The plaintiff claims he is still owed $834,489.61 as of July 16 per the contract.

Pollitt is seeking judgment in the amount of $834,489.61. He is represented by Matthew Ward of Dinsmore & Shohl in Huntington.

The case is assigned to Circuit Judge Louis "Duke" Bloom.
