WHEELING — A man is suing the city of Wheeling claiming rainwater is damaging his house.
Jay Folse claims he's requested the city fix a sidewalk in front of his home after more than six inches deep of rainwater collected in front of his home and was caused to flow toward his home and caused him damages, according to a complaint filed in Ohio Circuit Court.
Folse claims while the block he lives on had significantly newer sidewalks, only his home had not had the sidewalk replaced and it appeared that the newer sidewalks were capped over the old ones, making Folse's sidewalk significantly lower than the others.
Folse claims he also noticed the road had been paved over so many times that it was flush with the sidewalk, causing the flooding issue. He requested the sidewalk be repaired and the city attorney denied any liability for the flooding issue.
"The plaintiff is very concerned about the flooding causing significant damage to his house and further damage to the sideway," the plaintiff claims.
Folse is seeking the sidewalk to be repaired and compensatory damages in the amount of $7,500. He is representing himself
