Individuals sue Marshall University board of governor's for family member's death

HUNTINGTON — The Marshall University Board of Governors was named in a lawsuit alleging a woman died in its care.

Michelle Smith and Steven May, as co-executors of the estate of Izetta May, filed the lawsuit alleging Izetta May was a patient at Cabell Huntington Hospital and was under the care of Drs. Hisham Hirzallah and Paul Okhumale, who were both employed by Marshall, according to a complaint filed in Cabell Circuit Court.

The plaintiffs claim the defendant's employees gave Izetta May an extremely high dose of Amiodarone during a visit on July 23, 2019, and when she returned on Aug. 3, 2019, with worsening conditions, she was again given the medication, which likely caused Amiodarone associated pulmonary toxicity, according to the suit.

The plaintiffs claim her lung damage was irreversible and she later died. They claim the defendant was medically negligent and caused Izetta May's wrongful death.

The plaintiffs are seeking compensatory and punitive damages. They are represented by Alexander C. Ward.

The case is assigned to Circuit Judge Alfred Ferguson.
