CHARLESTON — A Glasgow couple is suing Paul White Chevrolet alleging injuries occurred on the car lot's property.
Patricia McClure presented to the defendant's car dealership on Jan. 8, 2020, and were engaged by a sales agent to assist in shopping for vehicles, according to a complaint filed in Kanawha Circuit Court.
Patricia and Michael McClure claim that when Patricia McClure was led from the street to the sale's lot, she slipped on snow and ice that was present in the path and she fell.
The plaintiff's fall caused her to land on her right side and shoulder area, according to the suit.
The McClures claim the defendant owed a duty of reasonable care under the circumstances and her Patricia McClure's fall was a breach of the defendant's duty owed to her and a failure to properly maintain business premises by failing to remove the ice and snow.
"By allowing snow and ice to remain in and around its business premises and to expose and lead customers into this dangerous condition known to the Defendant, the Defendant breached their duty to their invited customers to operate their automobile dealership in a safe and reasonable manner and not to expose their invited customers to dangerous conditions," the complaint states.
As a result of the fall, Patricia McClure suffered serious injuries and underwent medical treatment, according to the suit.
The plaintiffs claim the condition on the defendant's property that led to Patricia McClure's injuries were not open and obvious to the plaintiff as she was led onto the lot.
Patricia McClure also suffered the ability to enjoy life in the future, according to the suit.
The McClures are seeking compensatory damages. They are represented by Shannon M. Bland of Bland & Bland in Charleston.
The case is assigned to Circuit Judge Kenneth Ballard.
