WAYNE — A Fort Gay woman and her minor child are suing Frontier Communications for a car accident that caused injuries.
Ashley Justice and her minor child, Cameron Justice, were traveling on Oct. 17, 2019, in Wayne County when a Frontier vehicle entered the roadway directly into the plaintiff's lane of travel, according to a complaint filed in Wayne Circuit Court.
The plaintiffs claim they were proceeding in a safe, proper and cautious manner when the vehicle suddenly entered their lane of travel and Ashley Justice took evasive measures to avoid a collision, but, in doing so, she was forced to come off the roadway and hit another Frontier vehicle that was improperly parked.
"Due to the suddenness and location of the Defendant's employees' actions, the Plaintiffs were unable to avoid the collision," the complaint states.
The defendants did not have any caution signs, roadwork signs or flagmen alerting drivers of a work zone, according to the suit.
The plaintiffs claim the defendant was negligent and caused them to sustain severe injuries.
The defendant failed to keep a proper lookout ahead, failed to exercise due care, did not properly set up a work zone, failed to yield, failed to use proper warning cones, devices or flagmen and was not driving attentively, according to the suit.
"The Plaintiffs contend that all of their losses and damages...are the direct, proximate, and sole result of the negligence of the Defendants and that the Plaintiffs are without fault for the collision," the complaint states.
The plaintiffs are seeking compensatory damages with pre-judgment interest. They are represented by Joshua S. Ferrell and Nathan D. Brown of Ferrell and Brown in Williamson.
