Mother sues school board after daughter lost front teeth in playground accident

WILLIAMSON – A Mingo County woman has sued the county board of education after her daughter lost her two front teeth following a playground incident.

Kathleen Browning filed her complaint in Mingo Circuit Court on behalf of her daughter identified as S.B. against the Mingo County Board of Education.

According to the complaint, the daughter was a student at Gilbert PK-8 on May 13, 2019, when she was playing on a handicap swing set when the seat belt securing her snapped, causing her to fall to the ground. The fall knocked out her two adult front teeth.

The complaint says the daughter and her classmates lacked proper monitoring and supervision by teachers, aides and other school employees.

Browning accuses the defendant of negligence for failing to provide an safe play area, proper supervision, regular inspections of playground equipment and proper monitoring of students during play time.

She seeks compensatory damages for her daughter’s injury, pain and suffering and other injuries. She also seeks attorney fees, pre- and post-judgment interest, court costs and other relief.
